TERMS OF SERVICE: THE ØBL!V PROTOCOL

OVERVIEW

This website is operated by ØBL!V. Throughout the site, the terms “we”, “us” and “our” refer to ØBL!V. By accessing our platform and/or purchasing a $319 limited identity configuration from us, you engage in our “Service” and agree to be bound by the following premium terms, conditions, and legal protocols. If you do not agree to the entirety of this framework, you are expressly prohibited from accessing the website or securing our products.

1. ACCEPTANCE OF TERMS (THE CLIENT AGREEMENT)

By utilizing this platform, you certify that you fully comprehend and accept these Terms of Service, including our strict Refund, Sizing, and complimentary Shipping Protocols. This constitutes a binding legal agreement between you (the client) and ØBL!V. Any violation of these terms will result in immediate termination of your access and permanent blacklisting from future allocations.

2. COMPLIMENTARY SHIPPING POLICY

  • Free Initial Shipping: To maintain an elite client experience, ØBL!V provides 100% complimentary (Free) Standard Shipping on all initial drop allocations of our $319 configurations globally.

  • Free Damage-Replacement Shipping: In the rare event that a configuration arrives with verified transit damage and is approved under our 48-hour protocol, the shipment of the replacement item will also be processed with 100% complimentary shipping.

3. THE RIGHT TO REFUSE SERVICE (RESERVATION OF ALLOCATIONS)

Because our head-to-toe identities are strictly capped at 200 configurations globally, we maintain an elite standard. We reserve the absolute right to refuse service, cancel orders, or terminate allocations to anyone, at any time, without explanation. If our system flags your account for suspected commercial reselling, automated bot usage, or behavior that violates our brand ethos, your order will be instantly purged and refunded.

4. MODIFICATIONS TO PRICES AND LIMITED INVENTORY

  • Price Autonomy: We reserve the right to alter the pricing of our luxury configurations at any time without prior notice.

  • Scarcity Enforcement: Placing an item in your cart does not secure an allocation. Inventory is only locked upon successful payment completion. ØBL!V shall not be liable to you or any third party if a limited drop sells out during your checkout process. If you miss the drop, your allocation automatically deploys to the next client on the waitlist.

5. ACCURACY OF BILLING, SIZING, AND ACCOUNT DATA

  • The 10-Time Size Check Rule: You are strictly responsible for verifying your dimensions against our size charts 10 times before checkout.

  • The Post-Purchase Lock: You agree that our mandatory post-purchase Size Confirmation Email is your absolute final safety net. Once you confirm your sizes via email (or 12 hours pass without response), your configuration is permanently locked into deployment. We will not modify, exchange sizes, or reroute packages after this point.

  • Shipping Responsibility: We deploy items strictly to the verified address provided at checkout. ØBL!V is not liable for lost, stolen, or undelivered shipments resulting from inaccurate client data input.

6. INTELLECTUAL PROPERTY & TACTICAL DESIGN RIGHTS

All digital assets, photography, garment configurations, text, layout names (THE IDENTITY, THE LABORATORY, THE ARCHIVE), and brand conceptualizations are the exclusive intellectual property of ØBL!V. Any unauthorized reproduction, copying, mirroring, or exploitation of our visual layouts or premium designs for commercial purposes will result in immediate, aggressive legal prosecution.

7. LIMITATION OF LIABILITY (LEGAL SAFEGUARD)

In no event shall ØBL!V, our directors, officers, or creators be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind—including, without limitation, lost profits, lost revenue, or psychological distress—arising from your use of our service or products. Our liability is strictly limited to the maximum extent permitted by law, and shall never exceed the purchase price of your $319 bundle.

8. GOVERNING LAW

These Terms of Service and any separate deployment agreements whereby we provide you premium services shall be governed by and construed in accordance with the laws governing our operational headquarters.
